Terms of Service

Agreement and account

These terms govern business use of TopCrew. By creating an account, you agree to these terms, the Acceptable Use Policy, and the Data Processing Addendum. You must be at least 18 and authorized to bind your business. Keep credentials secure and use separate logins for team members. You are responsible for activity under your account. Homeowners use the Homeowner Terms.

Fees and cancellation

Features, limits, prices, and billing intervals are shown in your plan and at checkout. Subscriptions renew automatically until canceled. Phone usage is billed separately where applicable. Cancel in account settings; access continues through the paid period. No refunds for partial periods or unused time. Failed payments may suspend paid features. See the Billing & Refund Policy.

Content and permitted use

You retain ownership of your data and content and authorize TopCrew to process them to provide the service. You must have the rights and permissions needed for your uploads, connected accounts, and customer communications. TopCrew retains ownership of its software and grants access for your authorized use. Do not copy, resell, reverse-engineer, or misuse the service, or train external AI models on its outputs. The Privacy Policy explains data handling and deletion.

AI, communications, and job records

Review AI outputs and permissions for automated actions. You remain responsible for messages, decisions, and work performed under your business name. Outputs are not legal, tax, insurance, or accounting advice. Automated calls may be recorded and transcribed; callers receive notice of recording and AI assistance. Do not remove that notice. Follow the Messaging Terms. Job records and certificates are not inspections or guarantees of workmanship, compliance, or coverage. Obtain permission before sharing customer information or photos.

Contractor work and payments

You contract directly with homeowners and are responsible for the work, licenses, insurance, warranties, taxes, refunds, and disputes. Job payments go to your connected payment account. TopCrew does not hold funds in escrow or take a job fee. Payment processing is subject to the processor's terms.

Service and termination

Availability is not guaranteed. We may suspend or close accounts for nonpayment, unlawful use, or violations of these policies, with seven days notice unless urgent action is needed for spam, fraud, threats, or similar abuse. Canceling a subscription does not delete stored data; request deletion through account settings or our privacy request form.

Liability

TopCrew is provided "as is." Our total liability to you is capped at the amount you've paid us in the 12 months before the issue. We're not liable for indirect, consequential, or punitive damages. Some jurisdictions don't allow these limits; in those places, our liability is limited to the smallest extent the law allows.

Disputes

Email hello@topcrew.ai first and give us 30 days. Almost everything ends there.

If it doesn't, you and TopCrew agree that any dispute between us will be resolved by binding individual arbitration under the commercial rules of the American Arbitration Association, not in a court before a judge or jury. You and TopCrew each waive the right to a jury trial and the right to bring or join a class action or class arbitration.

Either of us can still bring a qualifying claim in small claims court. And you can opt out of this arbitration agreement by emailing hello@topcrew.ai with the subject "arbitration opt-out" within 30 days of first agreeing to these terms. Opting out changes nothing else about your account.

Changes

We may update these terms, the Acceptable Use Policy, or the Data Processing Addendum. If we make a material change to any of them, we'll email account owners at least 30 days before it takes effect and post the new version with a new date. Continuing to use TopCrew after the change means you accept the new terms.

Governing law

These terms are governed by the laws of Illinois. Anything not going to arbitration is resolved in the courts of Cook County, Illinois.
